1. Agreement to these Terms
These Terms are a legal agreement between you and PeaceCraft LLC, an Oregon limited liability company and the provider of Breakdown, "PeaceCraft," "we," "us," or "our." By accessing or using Breakdown, creating an account, starting a trial, purchasing a subscription, installing the app, or clicking to accept these Terms, you agree to be bound by these Terms.
If you use Breakdown on behalf of a company, organization, employer, client, or team, you represent that you have authority to bind that organization and that "you" includes both you and that organization. If you do not agree to these Terms, do not use Breakdown.
2. Eligibility
You must be at least 18 years old to use Breakdown. You may use Breakdown only if you can form a binding contract with PeaceCraft and are not prohibited from using the service under applicable law.
3. The Breakdown service
Breakdown is a network and application troubleshooting tool. It monitors network and app-health signals from the device where it runs and helps identify whether observed problems appear to originate in the local network, the ISP or Internet path, or the application side. Breakdown may include local monitoring, Evidence Reports, account and subscription features, updates, public IP/ASN enrichment, the AI-powered Breakdown feature, support and feedback workflows, crowdsourced health data, and team/company functionality.
Breakdown is not a traffic proxy, VPN, automatic remediation tool, managed security service, emergency service, or guarantee that a network or application issue will be detected, diagnosed, escalated, or resolved.
4. Software license
Subject to these Terms, PeaceCraft grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Breakdown app for your own personal or internal business troubleshooting purposes. We reserve all rights not expressly granted.
You may not copy, modify, distribute, sell, lease, sublicense, host as a service bureau, circumvent technical limits, extract credentials or secrets, interfere with the service, or reverse engineer Breakdown except to the extent applicable law prohibits that restriction.
6. Accounts, organizations, and security
Some features require an account, sign-in, device linking, or organization membership. You are responsible for keeping your account credentials secure and for activity under your account, except where caused by our breach of these Terms. You must provide accurate account and billing information and keep it current.
Organization owners and administrators may manage users, devices, subscription settings, team/company data, exports, and other organization-controlled features. If your account or device is linked to an organization, the organization's settings and administrator actions may affect your access and the data associated with that organization.
7. Trials, subscriptions, cancellation, and refunds
Paid plans, prices, features, device limits, billing periods, and trial periods are disclosed in the sign-up or checkout process. If a free trial is offered, you may cancel within the trial period stated during sign-up and you will not be charged. If you do not cancel before the trial ends, your subscription will begin and your payment method will be charged according to the plan you selected.
Subscriptions renew automatically unless canceled before the renewal date. You may cancel through the dashboard or other method we make available. Cancellation takes effect at the end of the then-current paid billing cycle, whether monthly or annual. Except where required by law or expressly stated by us in writing, payments are non-refundable and we do not provide refunds or credits for partial billing periods, unused time, downgrades, or unused features.
Our payment processor may process payments and provide billing portal functionality. Your use of payment services may be subject to that provider's terms and privacy policies.
8. Your data, uploads, and permissions
You retain ownership of information, content, files, feedback, support emails, Evidence Reports, notes, prompts, logs, screenshots, attachments, and other materials you submit, upload, sync, or make available through Breakdown, "User Data." You grant PeaceCraft a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, display, modify for formatting or technical operation, analyze, and use User Data as necessary to provide, secure, support, improve, and operate Breakdown and as otherwise described in our Privacy Policy.
User Data may include network and app details such as hostnames, IP addresses, service labels, endpoint identifiers, route observations, status snapshots, troubleshooting evidence, free-text explanations, and organization context. You are responsible for ensuring that you have the rights and permissions needed to provide User Data to Breakdown and to authorize us and our service providers to process it.
9. AI-powered Breakdown feature
The AI-powered Breakdown feature sends your issue note and selected troubleshooting evidence through Breakdown's API and to our AI provider so the feature can generate a response. You authorize PeaceCraft and its service providers to process those inputs, tool results, prompts, responses, token accounting, and related metadata to provide, secure, rate-limit, debug, and support the feature.
AI-generated outputs may be inaccurate, incomplete, stale, or unsuitable for your situation. You are responsible for reviewing outputs before relying on them or sharing them with an ISP, employer, IT team, app vendor, customer, or other third party. Breakdown does not provide professional engineering, legal, compliance, security, or incident-response advice.
10. Feedback, support, and Evidence Reports
If you send feedback, support emails, status snapshots, Evidence Reports, PDFs, screenshots, logs, or similar materials, you authorize us to use them to respond to you, troubleshoot, improve Breakdown, operate internal support and admin workflows, and enforce these Terms. Do not send secrets, regulated data, or third-party confidential information unless you have authority and it is necessary for the support request.
If you export or share an Evidence Report, you are responsible for reviewing it and deciding whether it is appropriate to send to another party.
11. Crowdsourced health data
Breakdown may collect and process de-identified and/or aggregated network and app-health measurements to produce broader ISP, Internet, App, and AppNet health insights. This may include health metrics, path/topology attributes, ISP or ASN information, app/service labels, timing, loss, jitter, and coarse network or regional context. The crowdsourced health dataset is designed not to store raw source IP addresses or user account identifiers, and we may generalize data, suppress small cohorts, or limit publication to reduce re-identification risk.
You authorize PeaceCraft to use crowdsourced health data to create, publish, display, analyze, and improve de-identified and/or aggregated health insights. You will not receive compensation for this use. You may opt out of crowdsourced health data participation. If you opt out, you will lose access to crowdsourced health insights because the feature depends on reciprocal participation.
12. Team and company functionality
Team and company functionality requires cloud processing and association of app data with user accounts, devices, teams, companies, or organizations. This can include all app details needed to provide the feature, including hostnames, service labels, endpoint identifiers, local and public network observations, health history, Evidence Reports, audit events, and organization membership.
You cannot opt out of the cloud processing required for team/company functionality while continuing to use that functionality. If you do not want that processing, do not use the team/company feature or disconnect from the organization where supported. Organization administrators may be able to access, export, delete, retain, or manage organization-associated data.
13. Third-party services
Breakdown depends on service providers such as hosting, security, authentication, payment processing, AI, IP enrichment, analytics, email, and support providers. Their services are not controlled by us, and their terms and privacy policies may apply. We are not responsible for third-party services except to the extent required by law or expressly stated in these Terms.
14. Acceptable use
You may not use Breakdown to violate law, infringe rights, transmit malware, abuse rate limits, disrupt the service, access another user's or organization's data, submit false payment or account information, upload malicious or unlawful content, scrape or probe our systems without permission, bypass subscription or technical limits, use the AI-powered Breakdown feature for purposes unrelated to network or application troubleshooting, or use support channels for spam, harassment, or abuse.
We may suspend or limit access if we reasonably believe your use creates security, legal, abuse, payment, operational, or service-integrity risk.
15. Ownership and feedback
PeaceCraft and its licensors own Breakdown, including software, designs, text, graphics, trademarks, logos, APIs, models of operation, generated service metadata, de-identified and/or aggregated insights, and all related intellectual property. You may not remove proprietary notices or use our marks without permission.
If you provide suggestions, ideas, or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or compensation.
16. Changes, updates, and availability
We may update, change, suspend, or discontinue any part of Breakdown at any time. Some updates may be required for continued use, security, compatibility, or legal compliance. We may impose or change limits on plans, devices, rate limits, storage, AI usage, evidence size, team functionality, or other service dimensions.
We try to make Breakdown reliable, but the service may be unavailable, delayed, inaccurate, or degraded. Backend failures generally affect only the feature that depends on the backend, but we do not guarantee uninterrupted access.
17. Termination
You may stop using Breakdown at any time and may cancel paid subscriptions as described above. We may suspend or terminate your access if you breach these Terms, fail to pay, create risk, misuse the service, or if continued service is no longer commercially or legally practical.
Sections that by their nature should survive termination will survive, including payment obligations, ownership, licenses needed to process prior User Data, disclaimers, limitations of liability, indemnity, dispute resolution, and governing law.
18. Disclaimers
Breakdown is provided "as is" and "as available." To the fullest extent permitted by law, PeaceCraft disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation.
We do not warrant that Breakdown will identify every network or application issue, that any diagnosis or Evidence Report is complete or correct, that any support escalation will resolve a problem, or that crowdsourced health data reflects every user, region, provider, application, or incident.
19. Limitation of liability
To the fullest extent permitted by law, PeaceCraft and its officers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, business interruption, substitute services, network outages, failed troubleshooting, or third-party claims, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, PeaceCraft's total liability for all claims arising out of or relating to Breakdown or these Terms will not exceed the greater of (a) the amount you paid PeaceCraft for Breakdown in the 12 months before the event giving rise to the claim or (b) US $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
20. Indemnity
You will defend and indemnify PeaceCraft from third-party claims, damages, and reasonable attorneys' fees to the extent arising from your User Data, unauthorized monitoring or uploads, misuse of Breakdown, violation of law, or breach of these Terms.
21. Dispute resolution; JAMS arbitration
Please contact us first so we can try to resolve disputes informally. Before filing a claim, you and PeaceCraft agree to send a written notice describing the dispute, the requested relief, and contact information, and to allow 30 days for informal resolution. Notices to PeaceCraft must be sent to the address in Section 25 and to support@breakdown.live.
Except for claims that may be brought in small-claims court, claims seeking only injunctive relief for actual or threatened misuse of intellectual property or unauthorized access to the service, or claims that cannot be arbitrated as a matter of law, you and PeaceCraft agree that any dispute, claim, or controversy arising out of or relating to Breakdown or these Terms will be resolved by final and binding individual arbitration administered by JAMS under its applicable rules, including the JAMS Consumer Arbitration Minimum Standards where applicable.
The arbitration will be conducted by a single neutral arbitrator. The arbitrator may award the same individual remedies that a court could award, but may not conduct a class, collective, consolidated, private-attorney-general, or representative proceeding except where applicable law prohibits waiver of that right. You and PeaceCraft waive the right to a jury trial and the right to participate in a class, collective, consolidated, private-attorney-general, or representative action to the fullest extent permitted by law.
If you are a consumer, the arbitration location and fees will be handled consistently with the JAMS Consumer Arbitration Minimum Standards. If in-person proceedings are required, they will take place in the county where you reside or another mutually agreed location unless JAMS rules require otherwise. Either party may bring an individual claim in small-claims court in a court of competent jurisdiction.
You may opt out of this arbitration agreement by sending written notice to PeaceCraft within 30 days after you first accept these Terms. Your opt-out notice must include your name, email address used for Breakdown, and a clear statement that you opt out of arbitration. Opting out of arbitration does not opt you out of any other part of these Terms.
22. Governing law and venue
These Terms are governed by Oregon law and applicable U.S. federal law, without regard to conflict-of-law rules. For disputes that are not subject to arbitration, the state and federal courts located in Oregon will have exclusive jurisdiction, and you and PeaceCraft consent to personal jurisdiction and venue there.
Nothing in these Terms limits mandatory consumer-protection rights that cannot be waived under the laws of your place of residence.
23. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect information. By using Breakdown, you acknowledge the Privacy Policy.
24. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. If changes are material, we will provide additional notice where required by law or where practical for the service. Your continued use of Breakdown after the effective date of updated Terms means you accept the updated Terms.
